PRIVACY POLICY

Balmoral Management Group Pty Ltd (BMG) is committed to respecting individual privacy and to ensuring that personal information it holds is handled appropriately and lawfully, in accordance with the Privacy Act 1988 (Cth) and the National Privacy Principles set out in Schedule 3 of that Act. This Website Privacy Notice explains our policy for dealing with personal information that we collect through BMG's website.

Personal information is information relating to an individual whose identity is apparent or can be reasonably ascertained from the information provided.

Any changes to this Website Privacy Notice will be posted on our website, so you are encouraged to check this Website Privacy Notice from time to time.

1. Collection of Personal Information
BMG will not collect personal information unless it is necessary for one or more of our functions or activities, or to comply with legal or regulatory obligations. If it is to be collected, it will be by lawful and fair means. Where possible we collect personal information directly during the course of our relationship with individuals. When we collect personal information we will, as far as practicable, inform the person of the reasons we are collecting the information and the types of organisations (if any) to which we may disclose the personal information eg service providers and professional advisers who assist us in our business.

2. Use and Disclosure
BMG will not use or disclose personal information for a purpose other than the primary purpose for which it is collected, and in some cases for secondary purposes but only if that is necessary and related to the primary purpose. Where we need to use personal information for purposes other than the primary purpose, we will obtain the individual’s consent where appropriate, necessary and practicable to do so.

In addition the National Privacy Principles allow us to use or disclose personal information in specified circumstances, for example where you have consented to the use and disclosure, or where such use or disclosure is required under or authorised by law (such as to comply with a subpoena or other order of court).

3. Data Security
BMG will take reasonable steps to protect the personal information it collects from misuse, loss, unauthorised access, modification or disclosure, and will take reasonable steps to destroy or de-identify personal information that is no longer needed for any purpose for which the information may be used or disclosed.

4. Access and Correction
BMG will provide access to personal information it holds following a reasonable request in writing to the BMG Privacy Officer, unless exceptional circumstances specified in the Privacy Act apply. If a request for personal information is denied, we will explain the reason for the denial. If access is sought for purpose of determining accuracy of the information and it is determined that the information is inaccurate, incomplete or out-of-date then BMG will take all reasonable steps to bring the information up-to-date.

5. Anonymity
Wherever lawful and practicable we respect the right of an individual to remain anonymous when dealing with us.

6. Transborder Data Flows
BMG may transfer personal information to a foreign country only if such transfer is permitted by the National Privacy Principles.
